Robert Mueller, former FBI Director and Partner at the law firm WilmerHale, has released his investigative report into the leagues handling of the Ray Rice suspension. The big question the report was looking to address was whether the NFL had knowledge of the second Ray Rice video before it was released to the public. Mueller concluded the NFL did not cover things up, but rather mismanaged the Rice suspension by failing to be more thorough in its investigation of the matter. We found no evidence that anyone at the NFL had or saw the in-elevator video before it was publicly shown. We also found no evidence that a woman at the NFL acknowledged receipt of that video in a voicemail message on April 9, 2014, the report said. The Mueller Report has been criticized for failing to address key allegations in a more definitive way. The problem, however, is less that Mueller did not do a good job (he did a very good job) and more the assignments inherent limitations. Specifically, Mueller faced a key obstacle: he had no subpoena power or the legal authority to compel the production of evidence or testimony. Mueller isnt a prosecutor working for the court; he works at a private firm and was hired by the NFL to generate a report. Without that subpoena power, he wasnt able to try and compel the Associated Press to reveal the identity of the woman at the NFL who is alleged to have confirmed receipt of the Rice video and adding, Youre right. Its terrible. There is of course no guarantee the AP would have revealed its source if forced to do so by a court, but it could have certainly encouraged the production of key evidence. And without that subpoena power, Mueller wasnt able speak to the lieutenant from an agency that apparently gave a detailed account of the second video to the Ravens before it went public. These are two critically important pieces of evidence that Mueller was unfortunately unable to properly consider. So rather than say the NFL never saw the video, he qualified that conclusion with the phrase we found no evidence that anyone at the NFL saw it. It doesnt, however, mean the evidence doesnt exist. All that to say, we cannot conclude with certainty that the NFL was engaged in a cover up. It is possible that the AP story was inaccurate. We simply dont know for certain. While some are left unsatisfied with the report, Mueller was thorough in his review. Over four months, his team interviewed 188 people, searched 400 computers and devices, and reviewed thousands of documents, emails and text messages. Still, the circumstances were such that Muellers powers were limited. Speaking of witnesses, there was a second limitation Mueller was facing. Witnesses were not facing a possible charge of perjury if they did not tell the truth. Perjury is knowingly lying under oath and its a crime that can result in jail time. Of course, there is also the criticism that this was not an independent investigation. Mueller was hired and paid by the league, and his law firm counts the NFL among its clients. As a result, there is not the distance between the NFL and Mueller that some would like. Ultimately, the Mueller Report was likely anticlimactic. Its findings corroborated the NFLs version of the story. Further, while the report recommends changes to NFL protocols when handling cases of domestic violence, the league has already taken remedial action by amending its Personal Conduct Policy, hiring a new head of discipline and seeking the counsel of domestic violence experts. As well, we have already seen dramatic and positive changes in the manner domestic violence is handled by leagues. Players like Jeffrey Taylor of the Charlotte Hornets and Slava Voynov of the L.A. Kings were suspended without pay when allegations of domestic violence materialized. Leagues have largely adopted a zero tolerance policy when it comes to domestic violence. Public sensibilities also seemed to have shifted towards greater intolerance. Between 2000 and 2014 there were 85 instances of domestic violence in the NFL with little in the way of sustained public outrage. Those days, however, are over. Indeed, Ray Rice changed absolutely everything. And thats the silver lining in this big sorted mess.
